The general rule
Foreign individuals who have worked or studied in China for at least one year can generally buy one residential property for their own use. The purchase is for living in, not for renting out or building a portfolio, and buyers typically sign a declaration to that effect.
What varies by city
Large cities add their own requirements, for example a period of local income tax or social insurance records and employment with a locally registered employer. Some cities have eased their rules in recent years. Always check the current rules for the specific city and district.
Permanent residents
Holders of Chinese permanent residence are generally treated more favorably and may not need to meet the employment conditions. Check the local rules.
Mortgages
Some banks lend to foreign buyers with local income, an employment contract and tax records, with more documents than for local borrowers. Many foreign buyers pay in full.
Paying from abroad
Moving money into China for a purchase involves foreign exchange rules and source-of-funds documents. Recent reforms have reportedly made it easier to convert foreign currency against a signed purchase contract; your bank and lawyer can confirm the current process.
Title and land use
Residential land in China is held on land-use rights, typically 70 years for residential land, counted from when the land was granted. Check the remaining term and the property's registration before you buy.
Before you commit
- Confirm your eligibility for that city in writing.
- Use a qualified local lawyer for the title and contract.
- See the home properly: in person, on a viewing trip, or with an independent Property Check.
